PLAN COMMISSION
6:00 p.m.
Mike Weinkauf called the meeting to order at 6:00 p.m. with Paul Beere, James
Joseph, Tom Rowntree and Mark Tamblyn present. Maureen Eckert arrived at
6:10 p.m.
Chris Johnson was absent.
Jonathan Schattner, Zoning Administrator, and Betty Novy, Clerk-Treasurer were
also present.
Joseph moved, 2nd by Tamblyn to approve the minutes of the August 2, 2010
meeting. Motion carried.
Pubic Hearings: There were none.
Action Items:
Application for Preliminary Plat Approval: Stoneridge North Subdivision
Location: Ridge Lane
Owner: Edward Stone

Schattner reported on review of the Stoneridge North preliminary plat by
objecting authorities and the Village Engineer. Ed Stone, developer, and
Gary Foat, surveyor, addressed the Committee. Stone reported on further
consideration regarding the bridal path surrounding the development. He
will be removing the path from the Final Plat and will make the necessary
amendments to the subdivision covenants and restrictions to reflect that change.
Foat indicated the future road designation between Lots 6 and 7 was incorrectly
platted on the original subdivision plat. It will be corrected with this
plat. Stone will have to assign a name to the road. Beere moved, 2nd
by Eckert to recommend approval of the Stoneridge North Preliminary Plat subject
to addressing the zoning administrator’s comments (as follows):
1) The previously dedicated
future road, located between Lot 6 and Lot 7, has not been assigned a road name.
2) The centerline of Maple Road,
which is actually the east line of the Section 5, Township 3 North, Range 19
East, must be labeled accordingly.
3) The name of the School
District is not mentioned on the face of the preliminary plat.
4) The owner of the property did
not provide the Village of Rochester a revised copy of the restrictive covenants
for this proposed development for review and approval. I would recommend that
the Village Planning Committee require that the property owner submit a revised
copy of the restrictive covenants for this development as part of the final plat
submittal.
5) The proposed development
yield has not been placed on the face of the preliminary plat.
6) An isolated natural resource
area exists on portions of Lot 8 and 9. A note should be place on the face of
the plat to minimize the number of trees to be cut down for the future
construction of the residential home, on-site sanitary system and proposed
driveway.
7) The owner of the proposed
development has not submitted the required fees for reviewing the above
referenced preliminary plat. I would recommend that prior to submitting the
final plat for our review, that the property owner submit the required fees.
Motion carried.
Request for amendments affecting Site Lighting Requirements and Rental
Restrictions to Development Agreement and Zoning Ordinance: Trail of Pines
Condominium Development

Roger Kieffer addressed the committee asking for an amendment to the development
agreement for Trail of Pines condominiums to remove a requirement for submitting
a site lighting plan that includes post lights along the private roadway.
Kieffer reported three exterior switch activated 100-watt light fixtures
installed for each condominium unit, two at the sides of the garage doors and
one on the porch. There is less than 25 feet from the front of each unit
to the private drive. He feels these fixtures provide sufficient light for
the development.
There was discussion on lighting requirements applicable to other condominium
and subdivision developments in the Village, noting that all high-density
developments approved within recent years were required to install post lights
adjacent to each residential unit. Consensus of the committee was to
continue to enforce this requirement for safety and consistency in condominium
areas.
Joseph moved, 2nd by Eckert not to recommend any amendments to the agreement for
Trail of Pines condominiums in regards to site lighting. Motion carried.
Kieffer then requested revision to a restriction on the development regarding
owner-occupied units. The development agreement, original zoning
ordinance, and declaration of condominium restrict rental of units to anyone
other than family members of the owner for more than five months. Kieffer
is having difficulty selling the condominium units and requested that the Plan
Commission consider a temporary conditional use to allow him to rent units for a
specific term, subject to Plan Commission review at completion of the term.
He indicated this would allow him to move forward with building out the rest of
the development.
Joseph stated Kieffer knew renting units was an issue when proposing this
development. He felt it would be a problem to open up condominium unit
rental for Trail of Pines when it has been denied for other condominium
developments. Joseph also noted residents on Mink Ranch Road have been
opposed to the development since the beginning. He did not think they
would be receptive to the requested change.
Eckert moved, 2nd by Joseph to recommend retaining the rental restrictions
originally agreed to for Trail of Pines condominiums. Motion carried.
Joseph moved, 2nd by Eckert to adjourn at 6:42 p.m. Motion carried.
