7:00 p.m.
Mike Weinkauf called the meeting to order at 7:00 p.m. with Paul Beere, Chris
Johnson, James Joseph, Tom Rowntree and Mark Tamblyn present. Maureen
Eckert was absent.
Jonathan Schattner, Zoning Administrator, and Betty Novy, Clerk-Treasurer were
also present.
Pledge of Allegiance.
Joseph moved, 2nd by Johnson to approve the minutes of the April 5, 2010 meeting
as printed. Motion carried.
Pubic Hearings:
Conditional Use for the continuation of a sand & gravel extraction operation
(Honey Creek Site), including washing, crushing of recycled concrete and asphalt
and an asphalt plant at 34604 Washington Avenue
Owners/Applicants: Payne & Dolan Inc.

Schattner presented an aerial view and panoramic photographs of the Payne &
Dolan- Honey Creek Gravel Pit. He clarified the conditional use request is
to extend an existing permit for two years.
Clint Weninger and Ray Postotnik, Payne & Dolan, addressed the Commission.
Weninger reported no changes to the conditional use request from what has been
done in the past. There was a question whether the series of ponds now
existing in the site would remain when they are done. Weninger indicated a
counter clock-wise progression through the site of mining and restoration.
The site will ultimately be restored according to the plan on file with Racine
County Planning and Development. Weninger also reported on utilization of
a rail line that runs adjacent to the gravel pit. The rail line is
utilized to send approximately 20 cars of sand to their Waukesha facility on an
annual basis. This helps cut down on some truck traffic. Schattner
reported visiting the site and noted it was clean, orderly, and that they
consistently restore mined areas as they move into new areas.
Additionally, he reported no complaints.
John Janaky, 34111 Washington Avenue, stated concern about operation of the hot
asphalt plant. He was particularly concerned about odors. Postotnik
indicated the asphalt plant was run at this location last year for state highway
projects and has been in operation on and off for the past 15 years.
Janaky indicated he is a long time resident. He has no problem with the
use now that he knows it has already been in operation.
Weinkauf asked for any additional comments on the Payne & Dolan Honey Creek
gravel pit. There were no further comments heard.

Dolan Kramer-Buss gravel pit. He reported this conditional use request is
also to extend an existing permit for two years.
Clint Weninger and Ray Postotnik, Payne & Dolan, addressed the Commission.
Weninger described this location as a low activity gravel pit with little
material left. The last time it was utilized was for fill on the
Burlington by-pass project. The gravel pit will not be in operation for
the long term. There are a few stockpiles and some materials left on site.
More seeding needs to take place. This is most likely the last renewal of
this conditional use permit. Restoration bonds and reclamation plans are
still on file with Racine County Planning and Development. The site will
be restored according to that plan. There was question about whether any
steep cliffs exist at the site. Weninger indicated they try to minimize
hazards by sloping all vertical surfaces, including the stock piles. Other
than that, efforts have been made to adequately sign the site and warn
trespassers of the hazards.
Novy reported receipt of correspondence from Joanna Storm, 850 N. Browns Lake
Road. The correspondence indicated no objection to renewal of the
conditional use permit.

Schattner presented an aerial view and panoramic photographs of the Racine
County Public Works gravel pit. He reported this conditional use request
is also to extend an existing permit for two years.
Jeff Katz, Racine County Public Works, addressed the Commission. Katz
reported restoration of the pit is occurring as they move along the east and
north lines of the parcel. There will be more restoration performed on the
south property line this spring. The operation includes crushing of
asphalt and concrete once a year in the fall for seven to ten days. The
gravel pit is expected to remain in operation for at least another 20 years.
Beere recalled problems in the past with trespassing at the site. Weinkauf
indicated kids used to go in there with ATVs. However, since someone was
heavily fined, there has been little activity of that type.
Joseph moved, 2nd by Tamblyn to close the public hearing session of the meeting
at 7:36 p.m. Motion carried.

Request for Extension: Site Plan Approval to construct and operate a gas
station/ convenience store/ car wash at 151 S. Millgate Drive
Applicant: Millgate Development LLC; James and Mary Hurst
Parcel Id# 176031911009020
James Hurst addressed the Commission. He reported difficulty obtaining
financing for this project and requested an extension on the deadline to begin.
He is now soliciting investors and is hoping to be able to start within the next
60 days. He indicated construction of the car wash may be staged for
a later date. This is an additional $500,000 cost. Joseph moved, 2nd
by Tamblyn to recommend a one year extension to June 11, 2011 on the approved
Specific Implementation Plan for 151 S. Millgate Drive. Motion carried.
Tamblyn moved, 2nd by Joseph to adjourn at 7:56 p.m. Motion carried.
